2. Subject of the agreement
The Provider grants the User access to software for automated cryptocurrency arbitrage on exchanges: Binance, BingX, Bitget, ByBit, Gate.io, KuCoin, LBank, MEXC.
The platform provides the following features:
- Real-time monitoring of price spreads between exchanges
- Automatic opening and closing of arbitrage positions based on configured rules
- API key and proxy server management
- Trade journal and analytics in the dashboard
- Trading strategy parameter configuration
The Provider supplies a software tool but does not manage User funds and is not responsible for trading results.
3. Acceptance procedure
Acceptance of this offer is any of the following actions by the User:
- Completing registration on the platform
- Paying for a subscription
- Adding an exchange API key
Acceptance means full and unconditional agreement with all terms of this agreement, the Privacy Policy, and acknowledgment that the User is aware of the risks associated with cryptocurrency trading.
To use the platform, the User must be of legal age (18+) and have the right to enter into contracts in their jurisdiction.
4. Rights and obligations
The Provider undertakes to:
- Ensure platform availability of at least 95% uptime during the billing period
- Store User API keys in encrypted form
- Notify the User of scheduled maintenance at least 24 hours in advance
- Provide support for platform-related issues
- Not share User data with third parties without consent
The User undertakes to:
- Provide accurate information during registration
- Maintain sufficient balance on exchanges for trade execution
- Not share account access with third parties
- Create API keys without withdrawal permissions
- Pay for the subscription in a timely manner
- Use the platform in accordance with applicable legislation
- Not attempt to bypass the platform's security mechanisms
5. Pricing and payment
Subscription pricing is determined by the current plan on the Pricing page:
Payment is made in cryptocurrency: USDT (TRC-20, BEP-20, ERC-20). The subscription is activated after blockchain transaction confirmation (usually 1-30 minutes). Invoices are generated in the dashboard under "Subscription Plans".
When renewing a subscription before the current period expires, remaining time is added. The subscription does not auto-renew.
6. Refund policy
Due to the digital nature of the services, refunds are provided in the following cases:
- Technical failure on the Provider's side causing complete platform downtime for more than 48 consecutive hours — proportional refund for the downtime period
- Double charge error — full refund of the overpaid amount
Refunds are not provided in the following cases:
- Dissatisfaction with trading financial results
- Account suspension due to platform rule violations
- Instability or outages on third-party exchanges
- Force majeure circumstances
- Payment was made more than 7 days ago
To request a refund, contact support@arbiboss.com within 7 days of payment.
7. Limitation of liability
The platform is provided "as is" (as is). The Provider is not liable for:
- Losses from trading operations executed by the platform
- Actions or inactions of exchanges, including API failures, asset delisting, commission changes
- Losses due to extreme volatility or force majeure
- Unauthorized account access if the User failed to secure their credentials
- Lost profits, missed opportunities
- Internet connection or User infrastructure failures
The Provider's aggregate liability for any User claims shall not exceed the amount paid for the last 30 days of subscription.
8. Risks and disclaimer
The User acknowledges and accepts the following risks:
- Market risk: the spread may collapse before both legs of the trade are executed
- Technical risk: exchange API failures, network delays, partial order execution
- Regulatory risk: changes in legislation in the User's jurisdiction
- Liquidity risk: insufficient order book depth for the specified volume
- Delisting risk: an exchange may cease trading of an asset
9. Prohibited actions
The User is prohibited from:
- Using the platform for money laundering or financing prohibited activities
- Creating multiple accounts to circumvent restrictions
- Reverse engineering, decompiling, or copying the platform's source code
- Reselling platform access to third parties without written permission
- Intentionally overloading platform servers with DDoS attacks
- Using the platform in jurisdictions where it is prohibited by law
10. Suspension and termination
The Provider may suspend or terminate the agreement unilaterally:
- If the User violates the terms of this agreement — immediately without refund
- If fraudulent activity is detected — immediately with notification to competent authorities
- If the platform ceases operations — with 30 days' notice and proportional subscription refund
The User may terminate the agreement at any time by deleting their account. The remaining subscription period is not refunded.
11. Changes to terms
The Provider may unilaterally modify the terms of this agreement. The User will be notified of changes by email at least 7 days before they take effect. Continued use of the platform after notification constitutes acceptance of the new terms. If the User disagrees with the changes, they may terminate the agreement before the changes take effect.
12. Governing law and disputes
This agreement is governed by the laws of Georgia. The parties undertake to resolve disputes through negotiation first. If no agreement is reached within 30 days of the claim, the dispute shall be referred to the competent court at the Provider's place of registration.
